1. General information

datalucid gmbh, based in Gamprin-Bendern (hereinafter also "we", "us"), is committed to protecting your personal data. In this privacy policy, we explain how we collect your personal data, what we do with it, for what purposes and on what legal basis this happens, and what rights and claims you have associated with it. If necessary, we will inform you in writing in good time about additional processing activities not mentioned in this privacy policy. In addition, we can inform you separately about the processing of your data, e.g. in declarations of consent, contractual terms, additional data protection declarations, forms and notices. We use the term "data" here as synonymous with "personal data" or "personal information".

“Personal data” means data that relates to an identified or identifiable person, i.e. conclusions about their identity can be drawn from the data itself or with appropriate additional data.

“Particularly sensitive personal data” is a category of personal data that is particularly protected under applicable data protection law. Particularly sensitive personal data includes, for example, data revealing racial and ethnic origin, health data, information about religious or ideological beliefs, biometric data for identification purposes and information about trade union membership.

“Processing” means any handling of personal data, regardless of the means and procedures used, in particular the acquisition, storage, use, modification, disclosure and deletion of data.

If you send us or disclose data about other people, such as family members, work colleagues, etc., we assume that you are authorized to do so and that this data is correct. By sending data about third parties, you confirm this. Please also ensure that these third parties have been informed about this privacy statement.

This privacy policy is designed to meet the requirements of the EU General Data Protection Regulation ("GDPR"), the Swiss Data Protection Act ("DSG") and the revised Swiss Data Protection Act ("revDSG"). However, whether and to what extent these laws are applicable depends on the individual case.

3. Categories of data we process

The processing of your personal data is limited to data that is necessary for the operation of a functional website and for the provision of our content, products and services. The processing of our users' personal data is based on the agreed purposes or a legal basis. We only collect personal data that is required to carry out and process our tasks and services or that you provide to us voluntarily. Depending on the occasion and purpose of the processing, we process different data about you.

3.1 Technical data

When you use our website, app or other electronic offerings ("website"), we collect the IP address of your end device and other technical data to ensure the functionality and security of these offerings. This data also includes logs in which the use of our systems is recorded. We generally store technical data for 6 months. In order to ensure the functionality of these offers, we can also assign you or your end device an individual code (e.g. in the form of a cookie, see section 14). The technical data itself does not allow any conclusions to be drawn about your identity. However, in the context of user accounts, registrations, access controls or the processing of contracts, they can be linked to other data categories (and thus possibly to your person).

The technical data includes, among other things

  • the IP address and information about the operating system of your end device

  • Name and URL of the requested website

  • the date, region and time of use, GMT time zone difference

  • notification of whether the request was successful (access status/http status code)

  • amount of data transferred

  • Websites that are accessed via our website

  • Website from which the access is made (so-called referrer URL)

  • the type of browser you use to access our online offering

  • the name of your internet provider

  • type and version of the browser used and other information provided by the user (such as geographical origin, language setting, add-ons used, screen resolution, etc.)

  • Logs that are created in our systems (e.g. the log of user logins on our website).


This can help us to design the website accordingly or, for example, to display a subpage for your region. We know which provider you use to access our website (and therefore also the region) based on the IP address, but this does not usually tell us who you are. However, this changes, for example, if you create a user account, as personal data can then be linked to technical data (e.g. we can know which browser you use to access an account via our website).

3.2 Registration data/newsletter order

 

Certain products and services can only be used with a user account or registration, which can be done directly with us or via our external login service providers. In doing so, you must provide us with certain data and we collect data on the use of the offer or service. We generally retain registration data for 12 months after the end of the use of the service or the termination of the user account.

The registration data includes, among other things

  • Information you provide when you create an account on our website (e.g. username, password, name, email, phone number, account details)

  • Contact information if you subscribe to our newsletter.

  • Ordering our products and services.

  • When you register with us, we create a user account for you with the following data:

  • Contact information

  • Credit card information

  • IP address

  • User ID (see technical data)

3.3 Communication data

When you contact us via the contact form, by email, telephone, chat, letter or other means of communication, we record the data exchanged between you and us, including your contact details and the marginal data of the communication. If we record telephone conversations or video conferences, we will specifically inform you of this. If we want or need to establish your identity, e.g. if you request information, we will collect data to identify you (e.g. a copy of an identity document). As a rule, we store this data for 12 months from the last exchange with you. This period may be longer if this is necessary for reasons of proof or to comply with legal or contractual requirements or for technical reasons. E-mails in personal mailboxes and written correspondence are generally stored for at least 10 years. Chats are generally stored for 2 years.

The communication data includes

  • your name and contact details

  • the manner, place and time of communication and, as a rule, its content (i.e. the content of e-mails, letters, chats, etc.). This data may also contain information about third parties. We may also use your ID number for identification purposes.

3.4 Master data

We define master data as the basic data that we require in addition to the contract data (see below) for the processing of our contractual and other business relationships or for marketing and advertising purposes, such as name, contact details and information, e.g. about your role and function, your bank account(s), your date of birth, customer history, powers of attorney, signature authorizations and declarations of consent. We process your master data if you are a customer or other business contact or work for one (e.g. as a contact person of the business partner), or because we want to contact you for our own purposes or the purposes of a contractual partner (e.g. as part of marketing and advertising, with newsletters, etc.). We receive master data from you yourself (e.g. when you make a purchase or register), from bodies for which you work, or from third parties such as our contractual partners, associations and address dealers, and from publicly accessible sources such as public registers or the internet (websites, social media, etc.). As a rule, we store this data for 10 years from the last exchange with you, but at least from the end of the contract. This period may be longer if this is necessary for reasons of proof or to comply with legal or contractual requirements or for technical reasons. In the case of pure marketing and advertising contacts, the period is normally much shorter, usually no more than 2 years since the last contact.

Master data is not collected across the board for every contact. Rather, the collection of master data depends on the individual case and the purpose of the processing. In general, it may include

 

  • Your name

  • your address

  • e-mail address

  • Telephone number and other contact details

  • your gender

  • Date of birth

  • Nationality

  • Data on related persons

  • Websites

  • Social media profiles

  • Photos and videos

  • Copies of identity cards

  • Details of your relationship with us (e.g. customer, supplier, visitor, service provider or service recipient, etc.)

  • Details of your status, assignments, classifications and mailing lists

  • Details of interactions with you

  • reports

  • Official documents (e.g. extracts from the commercial register, permits)

  • Payment information (e.g. bank details, account number and credit card details)

  • Declarations of consent and opt-out information


For customers, suppliers and partners, master data also includes information about the role or function in the company, qualifications and information about superiors, employees and information about interactions with these persons.

3.5 Contract data

 

We collect contract data in connection with the conclusion or performance of a contract, e.g. information about the products and the services provided or to be provided, as well as data from the period prior to the conclusion of the contract, information that is required or used for the performance of a contract, and information about feedback (e.g. complaints, feedback on satisfaction, etc.). We generally collect this data from you, from contractual partners and from third parties involved in the execution of the contract, but also from third-party sources and from publicly accessible sources. We generally store this data for 10 years from the last contractual activity, but at least from the end of the contract. This period may be longer if this is necessary for reasons of proof or to comply with legal or contractual requirements or for technical reasons.

The contract data includes, among other things

  • information about the conclusion of the contract, about your contracts, e.g. the type and date of conclusion and its duration

  • the performance and administration of the contracts, e.g. information in connection with billing, customer service, technical support and the enforcement of contractual claims

  • information about defects, complaints and contract amendments as well as information about customer satisfaction, which we can collect, for example, through surveys

  • Financial data, such as creditworthiness information (i.e. information that allows conclusions to be drawn about the probability of payment of receivables), information about reminders and debt collection.

We receive some of this data from you (e.g. when you make payments), but also from credit agencies and debt collection agencies as well as from public sources (e.g. commercial register).

3.6 Behavioral and preference data

Depending on the relationship we have with you, we try to get to know you and better tailor our products, services and offers to you. To do this, we collect and use data about your behavior and preferences. We do this by evaluating information about your behavior in our area, and we may also supplement this information with information from third parties, including from publicly available sources. Based on this, we can, for example, calculate the probability that you will use certain services or behave in a certain way. Some of the data processed for this purpose is already known to us (e.g. when you use our services), or we obtain this data by recording your behavior (e.g. how you navigate our website). We anonymize or delete this data when it is no longer relevant for the purposes pursued, which can be between 2-3 weeks and 24 months (for product and service preferences), depending on the type of data. This period may be longer if this is necessary for reasons of proof or to comply with legal or contractual requirements or for technical reasons. We describe how tracking works on our website in section 14.

Behavioral and preference data includes information about certain actions, such as your response to electronic communications (e.g. whether and when you opened an email) or your whereabouts, as well as your interaction with our social media profiles and your participation in prize draws, competitions and similar events.

Preference data provides us with information about your needs, which products or services might be of interest to you or when and how you are likely to respond to messages from us. We obtain this information from the analysis of existing data, such as behavioral data, so that we can get to know you better, tailor our advice and offers more precisely to you and generally improve our offers. In order to improve the quality of our analyses, we can link this data with other data that we also obtain from third parties or public sources (e.g. the Internet).

Behavioral and preference data can be evaluated on a personal basis (e.g. to show you personalized advertising), but also on a non-personal basis (e.g. for market research or product development). Behavioral and preference data can also be combined with other data (e.g. movement data can be used for contact tracing as part of a health protection concept).

3.7 Other data

We also collect data from you in other situations. In connection with official or court proceedings, for example, data is collected (such as files, evidence, etc.) that may also relate to you. We may also collect data for health protection reasons (e.g. as part of protection concepts). We may receive or produce photos, videos and audio recordings in which you may be recognizable (e.g. at events, through security cameras, etc.). We may also collect data about who enters certain buildings or has access rights to them and when (including during access controls, based on registration data or visitor lists, etc.), who participates in events or campaigns and when, or who uses our infrastructure and systems and when. The retention period for this data depends on the purpose and is limited to what is necessary. This ranges from a few days for many of the security cameras and usually a few weeks for contact tracing data to visitor data, which is usually stored for 3 months, to reports on events with images, which can be stored for several years or longer.

You provide us with much of the data mentioned in this Section 3 yourself (e.g. via forms, in the context of communication with us, in connection with contracts, when using the website, etc.). You are not obliged to do so, subject to individual cases, e.g. as part of binding protection concepts (legal obligations). If you wish to conclude contracts with us or make use of services, you must also provide us with data as part of your contractual obligation in accordance with the relevant contract, in particular master, contract and guest access or registration data. When using our website, the processing of technical data is unavoidable. If you wish to gain access to certain systems or buildings, you must provide us with registration data. For behavioral and preference data, however, you always have the option of objecting or not giving your consent.

We only provide you with certain services if you provide us with registration data because we or our contractual partners want to know who is using our services, because it is technically necessary or because we want to communicate with you. If you or a person you represent (e.g. your employer) wishes to conclude or fulfill a contract with us, we must collect corresponding master data, contract data and communication data from you, and we process technical data if you wish to use our website or other electronic offers for this purpose. If you do not provide us with the data required for the conclusion and execution of the contract, you must expect that we will refuse to conclude the contract, that you will commit a breach of contract or that we will not fulfill the contract. Similarly, we can only send you a response to an inquiry from you if we process the relevant communication data and - if you communicate with us online - possibly also technical data. It is also not possible to use our website without providing us with technical data.

Unless this is not permitted, we also obtain data from publicly accessible sources (e.g. debt collection registers, land registers, commercial registers, media or the Internet, including social media) or from authorities and other third parties (e.g. credit agencies, address dealers, associations, contractual partners, Internet analysis services, etc.).

The categories of personal data that we receive about you from third parties include, in particular, information from public registers, information that we learn in connection with official and legal proceedings, information in connection with your professional functions and activities (e.g. so that we can conclude and process transactions with your employer with your help), information about you in correspondence and meetings with third parties, creditworthiness information (insofar as we conduct business with you personally), information about you that people from your environment (family, advisors, legal representatives, etc.) provide to us so that we can conclude or process contracts with you or involve you (e.g. references, your address for deliveries, information about compliance with legal requirements such as fraud prevention, information about your creditworthiness, etc.). This includes, for example, references, your address for deliveries, powers of attorney, information to comply with legal requirements such as anti-fraud, anti-money laundering, anti-terrorism and export restrictions, information from banks, insurance companies and sales and other contractual partners of ours regarding the use or provision of services by you (e.g. payments, purchases, etc.), information from the media and the Internet about you (insofar as this is appropriate in the specific case). Your address and, if applicable, interests and other socio-demographic data (in particular for marketing and research) and data in connection with the use of third-party websites and online offers where this use can be attributed to you.

4. Purposes of processing

We process your data for the purposes explained below. Further information for the online area can be found in section 14 ff. These purposes and the underlying objectives represent legitimate interests of us and, where applicable, of third parties. You will find further information on the legal basis of our processing in section 5.

4.1 Communication

We process your data for purposes related to communication with you, in particular to respond to inquiries and assert your rights (section 11) and to contact you in the event of queries. In particular, we use communication data and master data for this purpose and, in connection with offers and services used by you, also registration data. We retain this data in order to document our communication with you, for training purposes, for quality assurance and for follow-up questions.

4.2 Contract fulfillment

We process your data in order to conclude and execute a contract with you (in particular for the creation of energy certificates) and to manage it. In particular, we process communication data, master data, registration data and contract data about you. This may also include data about third parties, e.g. if you order products or services for the benefit of a third party. This also includes data about potential customers that we receive from communication with you, at a trade fair or other business event. When contacting you, we use this data to check your creditworthiness and enter into a business relationship with you. We may use third parties, e.g. advertising service providers, banks, insurance companies or credit information providers, to manage and fulfill the contract with you in order to offer you our products and services.

4.3 Marketing and relationship management

We process your data for marketing and relationship management purposes. For example, we send personalized newsletters for products and services from us and possibly from selected third parties (e.g. advertising partners). Marketing and relationship management may include contacting you by email, telephone or other channels for which we have contact information from you. We and any selected third parties will only show you content or advertising tailored to your usage behavior or send emails for marketing purposes (e.g. newsletters) if and to the extent that you give us your consent, provided this is required by applicable law. You can object to such marketing activities at any time or withdraw your consent (sections 11 and 12).

 

As far as relationship management is concerned, we may use a customer relationship management system ("CRM") to store and process your data as described in this Privacy Policy (e.g. about contact persons, products and services offered to you, interactions, interests, marketing measures, newsletters, invitations to events and other information).

4.4 Product/service improvement and innovation

 

We continue to process your data for market research, to improve our services and operations, for product development and, among other things, to create models that can be used to assess other properties.

4.5 Reasons for safety

 

We process your data to protect our IT and other infrastructure (e.g. buildings). For example, we process data to monitor, analyze and test our networks and IT infrastructures, including access controls. We may also use surveillance systems, e.g. cameras, for security purposes. In such a case, we will inform you separately at the relevant points.

4.6 Compliance with the law

 

We process your data to comply with legal requirements, e.g. health security schemes, money laundering and terrorist financing, tax obligations, etc., and we may need to request further information from you to comply with such requirements ("Know Your Customer", "KYC") or as otherwise required by law and authorities.

4.7 Risk management, corporate governance and business development

We process your data as part of our risk management and corporate governance to protect ourselves from criminal or abusive activities. As part of our business development, we may sell businesses, parts of businesses or companies to others or acquire them from others or enter into partnerships, which may lead to the exchange and processing of data on the basis of your consent.

5. Legal basis for the processing of your data

Your consent

If we ask for your consent for certain processing (e.g. for receiving newsletters and for personalized content or advertising based on your usage behavior or for processing sensitive data), we will process your data on the basis of this consent. You can revoke your consent at any time with effect for the future by sending us a written notice (email is sufficient), see our contact details in section 2. If you would like to revoke your consent to online tracking, please note section 14. The revocation of your consent does not affect the legality of the processing we carried out before your revocation, nor the processing of your data on the basis of other processing grounds.

If we have not asked for your consent, we will process your data for other legal reasons, such as

  • a contractual obligation

  • a legal obligation

  • a vital interest of the data subject or of another natural person

  • to fulfil a public task

  • a legitimate interest, which includes compliance with applicable law and the marketing of our products and services, the interest in better understanding our markets and managing and developing our business, including its activities, safely and efficiently.

6. Profiling and automated decision-making

Zu denselben Zwecken können wir auch Profile erstellen, d.h. wir können Verhaltens- und Präferenzdaten, aber auch Stamm- und Vertragsdaten und Ihnen zugeordnete technische Daten kombinieren, um Sie als Person mit ihren unterschiedlichen Interessen und sonstigen Eigenschaften besser zu verstehen. Wir können das Profiling auch nutzen, um Ihre Kreditwürdigkeit zu beurteilen. Die Beurteilung von Immobilien kann ohne menschliche Überprüfung erfolgen und rechtliche Auswirkungen auf Sie haben. ​ In bestimmten Situationen kann es aus Gründen der Effizienz und Einheitlichkeit von Entscheidungsprozessen erforderlich sein, dass wir Sie betreffende Ermessensentscheide mit Rechtswirkungen oder möglicherweise erheblichen Nachteilen automatisieren («automatisierte Einzelentscheide»). Wir werden Sie in diesem Fall entsprechend informieren und die nach anwendbarem Recht erforderlichen Massnahmen vorsehen.

7. Transfer of data to third parties and social plug-ins

Im Zusammenhang mit unseren Verträgen, der Website, unseren Dienstleistungen und Produkten, unseren rechtlichen Pflichten oder sonst zur Wahrung unserer berechtigten Interessen und den weiteren in Ziffer 4) aufgeführten Zwecken übermitteln wir Ihre Personendaten auch an Dritte, insbesondere an die folgenden Kategorien von Empfängern: ​ 7.1 Angebote Dritter ​ Unsere Website oder App kann auch Angebote Dritter enthalten. Wenn Sie ein solches Angebot anklicken, übertragen wir im erforderlichen Umfang Daten an den jeweiligen Anbieter (z.B. die Angabe, dass Sie dieses Angebot bei uns gefunden haben und ggf. weitere Informationen, die Sie hierfür auf unserer Webseite oder App angegeben haben). ​ 7.2 Dienstleister ​ Wir arbeiten mit Dienstleistern im In- und Ausland zusammen, die in unserem Auftrag oder in gemeinsamer Verantwortlichkeit mit uns Daten über Sie bearbeiten oder in eigener Verantwortlichkeit Daten über Sie von uns erhalten (z.B. IT-Provider, Versandunternehmen, Werbedienstleister, Login-Dienstleister, Reinigungsunternehmen, Bewachungsunternehmen, Banken, Versicherungen, Telekommunikationsunternehmen, Kreditauskunfteien, Anbieter von Adressüberprüfungen, Rechtsanwälte) oder die wir beauftragen, personenbezogene Daten für einen der oben genannten Zwecke in unserem Namen und nur gemäss unseren Anweisungen zu bearbeiten. ​ 7.3 Vertragspartner inklusive Kunden ​ Wenn es der jeweilige Vertrag erfordert, geben wir Ihre Daten an andere Vertragspartner weiter. Wenn wir ein Geschäft oder Vermögenswerte verkaufen oder kaufen, können wir Ihre Daten an den potenziellen Verkäufer oder Käufer eines solchen Geschäfts oder Vermögenswerts weitergeben, an den wir unsere Rechte und Pflichten abtreten oder übertragen. ​ 7.4 Behörden ​ Wir können Personendaten an Ämter, Gerichte und andere Behörden in der Schweiz oder im Ausland weitergeben, wenn wir dazu rechtlich verpflichtet oder berechtigt sind oder dies zur Wahrung unserer Interessen als erforderlich erscheint. Die Behörden bearbeiten in eigener Verantwortlichkeit Daten über Sie, die sie von uns erhalten. ​ 7.5 Social Plug-ins ​ Auf unseren Webseiten setzen wir keine Social-Media-Plugins ein. Sofern unsere Webseiten Symbole von Social-Media-Anbietern enthalten (z. B. LinkedIn), nutzen wir diese lediglich zur passiven Verlinkung auf die Seiten der jeweiligen Anbieter. ​ 7.6 Einbindung von Google Maps ​ Auf dieser Website nutzen wir das Angebot von Google Maps. Dadurch können wir Ihnen interaktive Karten direkt in der Website anzeigen und ermöglichen Ihnen die komfortable Nutzung der Karten-Funktion. Rechtsgrundlage für die Nutzung der Karten ist Ihre Einwilligung, d.h. die Einbindung erfolgt nur nach Ihrer Einwilligung. ​ Wenn Sie Ihre Einwilligung erteilt haben, erhält Google die Information, dass Sie die entsprechende Unterseite unserer Website aufgerufen haben. Zudem werden die oben genannten grundlegenden Daten wie IP-Adresse und Zeitstempel übermittelt. Dies erfolgt unabhängig davon, ob Google ein Nutzerkonto bereitstellt, über das Sie eingeloggt sind, oder ob kein Nutzerkonto besteht. Wenn Sie bei Google eingeloggt sind, werden Ihre Daten direkt Ihrem Konto zugeordnet. Wenn Sie die Zuordnung mit Ihrem Profil bei Google nicht wünschen, müssen Sie sich vor Aktivierung des Buttons ausloggen. Google speichert Ihre Daten als Nutzungsprofile und nutzt sie für Zwecke der Werbung, Marktforschung und/oder bedarfsgerechten Gestaltung seiner Website. Eine solche Auswertung erfolgt insbesondere (selbst für nicht eingeloggte Nutzer) zur Erbringung von bedarfsgerechter Werbung und um andere Nutzer des sozialen Netzwerks über Ihre Aktivitäten auf unserer Website zu informieren. Ihnen steht ein Widerspruchsrecht zu gegen die Bildung dieser Nutzerprofile, wobei Sie sich zur Ausübung dessen an Google richten müssen. ​ Die erhobenen Informationen werden auf Servern von Google, auch in den USA, gespeichert. Dort erhalten Sie auch weitere Informationen zu Ihren diesbezüglichen Rechten und Einstellungsmöglichkeiten zum Schutze Ihrer Privatsphäre: www.google.de/intl/de/policies/privacy. ​ 7.7 Einbindung von YouTube-Videos ​ Wir haben YouTube-Videos in unser Online-Angebot eingebunden, die auf YouTube.com gespeichert sind und von unserer Website aus direkt abspielbar sind. Diese sind alle im „erweiterten Datenschutz-Modus“ eingebunden, d.h. dass keine Daten über Sie als Nutzer an YouTube übertragen werden, wenn Sie die Videos nicht abspielen. Erst wenn Sie die Videos abspielen, werden die nachfolgend genannten Daten übertragen. Auf diese Datenübertragung haben wir keinen Einfluss. Rechtsgrundlage für die Anzeige der Videos ist Ihre Einwilligung, d.h. die Einbindung erfolgt nur nach Ihrer Einwilligung. ​ Durch den Besuch auf der Website erhält YouTube die Information, dass Sie die entsprechende Unterseite unserer Website aufgerufen haben. Zudem werden die oben genannten grundlegenden Daten wie IP-Adresse und Zeitstempel übermittelt. Dies erfolgt unabhängig davon, ob YouTube ein Nutzerkonto bereitstellt, über das Sie eingeloggt sind, oder ob kein Nutzerkonto besteht. Wenn Sie bei YouTube eingeloggt sind, werden Ihre Daten direkt Ihrem Konto zugeordnet. Wenn Sie die Zuordnung mit Ihrem Profil bei YouTube nicht wünschen, müssen Sie sich vor Aktivierung des Buttons ausloggen. YouTube speichert Ihre Daten als Nutzungsprofile und nutzt sie für Zwecke der Werbung, Marktforschung und/oder bedarfsgerechten Gestaltung seiner Website. Eine solche Auswertung erfolgt insbesondere (selbst für nicht eingeloggte Nutzer) zur Erbringung von bedarfsgerechter Werbung und um andere Nutzer des sozialen Netzwerks über Ihre Aktivitäten auf unserer Website zu informieren. Ihnen steht ein Widerspruchsrecht gegen die Bildung dieser Nutzerprofile zu, wobei Sie sich zur Ausübung dessen an YouTube richten müssen. ​ Die erhobenen Informationen werden auf Servern von Google, auch in den USA, gespeichert. Die Auftritte betreiben wir bei Twitter, LinkedIn, YouTube und erheben dort in Ziffer 3 und nachfolgend beschriebenen Daten über Sie. ​ Wir erhalten diese Daten von Ihnen und den Plattformen, wenn Sie über unsere Online-Auftritt mit uns in Kontakt kommen (z.B., wenn Sie mit uns kommunizieren, unsere Inhalte kommentieren oder unsere Präsenz besuchen). 8. Transfer of data abroad

As explained in section 7, we also disclose data to other bodies. These are not only located in Switzerland. Your data may therefore also be processed in Europe, but in exceptional cases in any country in the world.

 

We only transfer data to countries without adequate legal data protection if this is necessary for the performance of a contract or the assertion or defense of legal claims, or if such a transfer is based on your express consent or is subject to guarantees that ensure the protection of your data, such as the standard contractual clauses approved by the European Commission.

9. How long we keep your personal data

15. Tracking tools

Based on your consent, we use tracking tools to ensure that our website is designed to meet your needs and is continuously optimized. We also use tracking tools to statistically record the use of our website and to evaluate it for the purpose of optimizing the content we show you.

We use Google Analytics, Amplitude and Smartlook based on your consent.

Google Analytics: Google Ireland (based in Ireland) is the provider of the “Google Analytics” service and acts as our processor. Google Ireland relies on Google LLC (based in the USA) as its processor (both “Google”). Google uses performance cookies (see above) to track the behavior of visitors to our website (duration, frequency of pages viewed, geographical origin of access, etc.) and uses this to create reports for us on the use of our website. We have configured the service so that the IP addresses of visitors in Europe are shortened by Google before being forwarded to the USA and therefore cannot be traced back. We have deactivated the “Data sharing” and “Signals” settings. Although we can assume that the information we share with Google is not personal data for Google, it is possible that Google can use this data to draw conclusions about the identity of visitors for its own purposes, create personal profiles and link this data to these people’s Google accounts. If you agree to the use of Google Analytics, you explicitly consent to such processing, which also includes the transfer of personal data (in particular website and app usage data, device information and individual IDs) to the USA and other countries. 16. Targeting tools

Based on your consent, we use the following targeting tools to ensure that only advertising that corresponds to your actual or inferred interest is displayed on your device:

We use Google Ads, LinkedIn Ads and Twitter Ads based on your consent.

Google Ads: We use Google Ads to draw attention to our offers using advertisements. If you access our website via a Google ad, Google Ads will store a cookie on your device. The legal basis for processing your data is your consent, i.e. integration only takes place after you have given your consent. The advertising material is delivered by Google via so-called "ad servers". For this purpose, we and other websites use so-called ad server cookies, which can be used to measure certain parameters for measuring success, such as the display of ads or clicks by users. Having said that, a privacy policy is a statement that discloses some or all of the ways a website collects, uses, discloses, processes, and manages the data of its visitors and customers. It usually also includes a statement regarding the website' s commitment to protecting its visitors' or customers' privacy, and an explanation about the different mechanisms the website is implementing in order to protect privacy.


Different jurisdictions have different legal obligations of what must be included in a privacy policy. You are responsible for making sure you are following the relevant legislation to your activities and location.
